Terms of Service - ATWOZ Cosmetics

These Terms of Service govern the use of https://www.atwozcosmetics.com/ and purchases from ATWOZ COSMETICS (PTY) LTD. By accessing the website, creating an account or placing an order, you agree to these terms together with our Refund Policy, Privacy Policy and Shipping Policy. Mandatory rights under South African law remain unaffected.

1. Eligibility and account responsibility

You must have legal capacity to enter into a transaction or use the website with the involvement of a parent or legal guardian. Information supplied to us must be accurate and current. You are responsible for protecting your login details and for activity performed through your account until you notify us of suspected unauthorised use.

2. Products and website information

We aim to display descriptions, images, colours, availability and prices accurately. Screen settings, packaging updates, supplier changes and photography may cause reasonable differences. Images are illustrative unless stated otherwise. Customers must check suitability, ingredients, instructions, colours, shades, sizes and variations before purchase.

3. Prices and payment

Prices are shown in South African Rand unless indicated otherwise. Delivery or other disclosed charges are added at checkout. Payment must be completed using an available payment method. An acknowledgement email confirms receipt of an order request; it does not necessarily mean that we have accepted the order.

4. Order acceptance and cancellation by us

An order is accepted when we confirm processing or dispatch. We may decline or cancel an order before delivery because of unavailable stock, a material pricing or product error, failed payment verification, suspected fraud, delivery restrictions, unlawful activity, supplier failure or circumstances beyond reasonable control. If we cancel after receiving cleared payment, we will refund the affected amount unless another solution is agreed.

5. Customer cancellation, returns and refunds

Cancellation requests must be made immediately and cannot be guaranteed once processing begins. Returns, defective goods, hygiene exclusions, refund assessment and approved remedies are governed by our Refund Policy and applicable South African consumer law.

6. Delivery and collection

Delivery dates are estimates. The customer must provide a complete address and a reachable telephone number. Courier delays, failed delivery attempts, refused parcels, collection orders and transfer of risk are governed by our Shipping Policy.

7. Promotions and discount codes

Promotions may have separate conditions, dates, stock limits and qualifying products. Unless expressly allowed, promotions and discount codes cannot be combined, exchanged for cash, retrospectively applied or transferred. We may withdraw a promotion affected by an obvious error, abuse or unlawful activity.

8. Acceptable use

You may not misuse the website, interfere with security, introduce malicious code, scrape data without permission, impersonate another person, submit false payment or delivery details, infringe intellectual-property rights, use the service unlawfully, or attempt unauthorised access to accounts or systems.

9. Intellectual property

The ATWOZ Cosmetics name, site design, original photographs, graphics, text, logos and other protected material belong to us or our licensors. They may not be copied, republished, sold, modified or commercially exploited without written permission, except where law permits.

10. Reviews and submitted content

If you submit a review, photograph, question or other content, you confirm that it is truthful, lawful and does not violate another person’s rights. We may moderate or remove spam, abuse, unlawful material, personal information or misleading content. You grant us a non-exclusive licence to display submitted content for operation and promotion of our services, subject to applicable privacy law.

11. Third-party services

Payment gateways, couriers and external links are operated by third parties under their own terms. We are not responsible for an external website merely because it is linked from our store. Nothing in this clause excludes responsibility that the law places on ATWOZ Cosmetics.

12. Warranties and liability

We do not promise uninterrupted or error-free access to the website. To the maximum extent legally permitted, ATWOZ Cosmetics is not liable for indirect or consequential loss arising from events outside our reasonable control. Our liability is not excluded or limited where doing so would be unlawful, including mandatory rights under the CPA.

13. Force majeure

We are not responsible for delay or failure caused by events reasonably beyond our control, including severe weather, fire, flood, civil disruption, strikes, supplier shortages, transport interruption, power failure, cyber incidents, government action or widespread system failure. We will take reasonable steps to reduce the effect where possible.

14. Governing law and changes

These terms are governed by the laws of the Republic of South Africa. If one clause is unenforceable, the remaining clauses continue to apply. We may update these terms prospectively by publishing a revised version. Orders already accepted remain subject to the version applicable when the order was placed, unless the law requires otherwise.
